1. AGREEMENT TO TERMS
Welcome to PositionPTT.com (the "Site" or "Store"), operated by PositionPTT, Inc. (referred to herein as "we," "our," "us," or "PositionPTT"). By accessing, browsing, or purchasing from this Site, you agree to be legally bound by these Terms of Service (the "Terms"), including all policies, guidelines, and additional terms referenced herein. If you do not agree to these Terms, please do not use this Site or purchase any products or services from us.
These Terms apply to all users of the Site, including but not limited to browsers, customers, merchants, and any other visitors. Your use of the Site and any transaction completed through the Site constitutes your acceptance of these Terms in their entirety.
2. ELIGIBILITY
By using this Site and making purchases, you represent and warrant that:
- You are at least 18 years of age or the age of majority in your jurisdiction of residence
- You have the legal capacity to enter into this agreement
- You are not a person or entity prohibited by applicable law from using this Site
- All information you provide is accurate, truthful, and complete
- You will comply with all applicable federal, state, provincial, and local laws, rules, and regulations
PositionPTT reserves the right to refuse service to anyone for any reason at any time without prior notice.
3. PRODUCTS AND SERVICES
PositionPTT offers Push-to-Talk over Cellular (PoC) radios, devices, accessories, and related telecommunications services. Our product offerings include:
- PTT radios and compatible devices
- Monthly service plans and airtime subscriptions
- GPS tracking and fleet management services
- Accessories, replacement parts, and add-on services
- Technical support and customer service
All product descriptions, pricing, and availability information are subject to change without notice. We undertake no obligation to update, amend, or clarify pricing information or product specifications except as required by law.
4. PRICING AND PAYMENT
4.1 Pricing
All prices are displayed in U.S. dollars unless otherwise specified. Prices are subject to change at any time without prior notice. Prices do not include applicable sales tax, shipping charges, or service fees unless explicitly stated.
4.2 Payment Methods
We accept all major credit cards, debit cards, and other payment methods as displayed on our checkout page. By providing payment information, you authorize PositionPTT to charge the total amount due to your selected payment method.
4.3 Billing
Recurring service charges (such as monthly airtime subscriptions) will be automatically billed to your payment method on the dates you agree to at checkout. You are responsible for maintaining current and accurate payment information in your account.
4.4 Billing Errors
If you believe an error has been made on your invoice or billing statement, please contact our customer service team within 30 days of the charge. We will investigate and correct any legitimate billing errors.
5. ORDERS AND ACCEPTANCE
5.1 Order Placement
Placing an order does not guarantee immediate acceptance. All orders are subject to our acceptance, which occurs upon shipment of your order from our facility or the receipt of a shipping confirmation email. We reserve the right to refuse or cancel any order at our discretion.
5.2 Order Confirmation
Upon successful order placement, you will receive an order confirmation email containing your order details. Please review this confirmation carefully and contact us immediately if you identify any errors.
5.3 Modification and Cancellation
You may request to modify or cancel your order within 24 hours of placement. After this period, your order may have entered fulfillment and cannot be modified or cancelled. Contact customer service to attempt cancellation of in-process orders.
6. SHIPPING AND DELIVERY
6.1 Shipping Methods
We offer several shipping options, including standard and expedited delivery. Shipping costs are calculated and displayed at checkout based on your destination address and selected shipping method.
6.2 Delivery Timeframes
Estimated delivery dates are provided for reference only and are not guaranteed. Delivery timeframes begin upon shipment and may be affected by carrier delays, weather, customs processing (for international orders), or other unforeseen circumstances beyond our control.
6.3 Risk of Loss
Risk of loss and title to products transfer to you upon delivery to the carrier or upon your receipt, whichever occurs first. You are responsible for filing claims for damaged or lost shipments with the carrier.
6.4 Shipping Address
You are responsible for providing a complete and accurate shipping address. PositionPTT is not responsible for shipments sent to incorrect or incomplete addresses provided by you.
7. RETURNS AND REFUNDS
7.1 Return Period
We offer a 30-day money-back guarantee on all hardware purchases (excluding applicable service fees, airtime charges, and shipping costs). Returns must be initiated within 30 days of delivery.
7.2 Return Conditions
To be eligible for a return, products must be:
- Unused or in like-new condition
- In original or equivalent protective packaging
- Accompanied by all original accessories and documentation
- Have no evidence of tampering or misuse
7.3 Return Process
To initiate a return:
- Contact our customer service team at support@positionptt.com
- Obtain a Return Merchandise Authorization (RMA) number
- Ship the product back to us with the RMA number clearly marked
- Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product
7.4 Refund Processing
Upon receipt and inspection of your return, we will process your refund within 5-10 business days. Refunds are issued to your original payment method. Please allow 3-5 additional business days for the credit to appear on your statement, depending on your financial institution.
7.5 Non-Returnable Items
The following items are non-returnable:
- Airtime, service subscriptions, and monthly service charges
- Digital products, software, and firmware downloads
- Customized or engraved items
- Items showing signs of wear, damage, or misuse
8. WARRANTIES
8.1 Hardware Warranty
All PositionPTT radios and devices include a 1-Year Limited Warranty covering defects in materials and workmanship, provided that:
- The device maintains an active service subscription
- The device was not damaged due to misuse, accident, water damage, or physical abuse
- Repairs or modifications were not performed by unauthorized parties
8.2 Warranty Coverage
The 1-Year Limited Warranty covers replacement or repair of defective components at our sole discretion. The warranty does not cover:
- Batteries or battery degradation
- Accessories or cosmetic damage
- Damage from water, extreme temperatures, or environmental factors
- Damage resulting from failure to follow instructions or proper maintenance
8.3 Warranty Claims
To file a warranty claim, contact our customer service team with proof of purchase and documentation of the defect. We will determine eligibility and either repair or replace the device.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSITIONPTT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF POSITIONPTT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO POSITIONPTT IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
10. DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY PROVIDED IN SECTION 8, THE SITE AND ALL PRODUCTS, SERVICES, CONTENT, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
POSITIONPTT DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT DEFECTS WILL BE CORRECTED.
11. PROHIBITED CONDUCT
You agree not to use the Site or services for any unlawful, unauthorized, or prohibited purpose. Specifically, you agree not to:
- Use the service for illegal activities or to violate any applicable laws
- Transmit worms, viruses, malware, or any code of a destructive nature
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its services without written permission
- Attempt to gain unauthorized access to any portion of the Site or related systems
- Harass, threaten, abuse, or harm others
- Engage in spam, phishing, or other deceptive practices
- Infringe on intellectual property rights
- Collect or track personal information about others
- Interfere with the operation of the Site or networks connected to it
- Impersonate another person or misrepresent your affiliation
A breach of any of these Terms will result in immediate termination of your account and services.
12. INTELLECTUAL PROPERTY RIGHTS
12.1 Site Content
All content on the Site, including text, graphics, logos, images, audio clips, digital downloads, and software (collectively, the "Content"), is the exclusive property of PositionPTT or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.
12.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to view and print Content solely for personal, non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or services obtained from the Site.
12.3 User Content
You retain ownership of any content you submit, upload, or post to the Site (including reviews, comments, and feedback). By submitting content, you grant PositionPTT a worldwide, royalty-free, perpetual, irrevocable, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute the content in any media.
13. PRIVACY AND DATA PROTECTION
Your use of the Site and provision of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information. Your submission of information through the Site, including payment details, is subject to our Privacy Policy.
14. SERVICE INTERRUPTIONS
PositionPTT may, without liability or prior notice, modify, suspend, or discontinue the Site or any services, features, or content thereon at any time for any reason, including but not limited to maintenance, updates, or operational reasons. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.
PositionPTT is not responsible for service interruptions caused by circumstances beyond our reasonable control, including but not limited to:
- Natural disasters or acts of God
- War, terrorism, or civil unrest
- Strikes or labor disputes
- Government actions or regulations
- Carrier or network outages
- Technical failures or equipment malfunction
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless PositionPTT, its officers, directors, employees, agents, and successors from any and all claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Site or services
- Your violation of these Terms
- Your infringement of any intellectual property rights
- Your harm or injury to any third party
- Any content you submit or transmit
16. GOVERNING LAW AND DISPUTE RESOLUTION
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which PositionPTT is incorporated, without regard to conflicts of law principles.
16.2 Dispute Resolution
Any dispute, claim, or controversy arising from or relating to these Terms, your use of the Site, or any products or services shall first be addressed through good-faith negotiation between you and PositionPTT. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, rather than in court.
16.3 Arbitration Details
- The arbitration shall be conducted in the English language
- Each party shall bear its own costs and attorney fees
- The arbitrator's decision shall be final and binding
- You agree to arbitration on an individual basis and waive any right to jury trial
16.4 Exceptions
Notwithstanding the foregoing, either party may seek preliminary injunctive relief in court to prevent irreparable harm or to protect intellectual property rights.
17. MODIFICATIONS TO TERMS
PositionPTT reserves the right to update, modify, or amend these Terms at any time. Changes will be effective upon posting to the Site, and your continued use of the Site following any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically for updates. The date of the most recent update is noted at the top of this document.
18. ACCOUNT MANAGEMENT
18.1 Account Creation
To purchase products or access certain services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account.
18.2 Account Termination
PositionPTT reserves the right to suspend or terminate your account and access to the Site at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or non-payment.
18.3 Account Information
You agree to provide accurate, current, and complete information during account creation and to update your information as necessary to maintain accuracy.
19. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites and services that are not operated by PositionPTT. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is subject to their terms and conditions and privacy policies. We encourage you to review their policies before providing any personal information or making purchases.

21. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.
22. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any additional terms posted on the Site, constitute the entire agreement between you and PositionPTT regarding your use of the Site and services, and supersede all prior negotiations, representations, and agreements, whether written or oral.
23. WAIVER
The failure of PositionPTT to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If PositionPTT waives any breach, such waiver shall not constitute a waiver of any subsequent breach.
